Legal standing of neighbours in the procedures to grant planning permission The Diploma Thesis Zuzana Jílková Abstract The Diploma Thesis entitled "Legal standing of neighbours in the procedures to grant planning permission" presents an analysis of the concept of the "neighbour" in the individual procedures to grant a planning permission under the Building Act, namely the planning permission proceedings, the summary planning permission proceedings, the planning consent issuance, the conclusion of a public contract and the regulatory plan issuance. Procedural rights of the neighbour are analysed in detail. The neighbour, in its capacity as an interested person, may actively use these rights and thereby influence the course and outcome of the proceedings. The thesis focuses primarily on the planning permission proceedings and objections which neighbours may raise against the construction project under the conditions set out in the Building Act. The aim of the thesis is to create an image of the neighbour by means of an analysis of the various procedures and to outline the problematic aspects of the current legislation regarding in particular the defence before the administrative courts in the simplified procedures. Word That Matters. Humanity and Ethics in the Thought of Emmanuel Lévinas

In five chapters, this thesis traces the question of humanity in the thought of the French philosopher Emmanuel Lévinas, mainly in his works De l'évasion (1935), De l'existence à l'existant (1947), Totalité et infini (1961) and Éthique comme philosophie première (1982), which represent various stages of his philosophical development. It offers an exposition of Lévinas's most original concepts, follows their development and sketches their parallel and/or polemic concepts in the European thought, placing them within the context of Lévinas's life-work. For Lévinas, the question of humanity appears as a transpostition of the question of God, who can not become an object of rational inquiry. In conclusion, the question of humanity becomes the theological issue par excellence. This study tries to show how theology can draw inspiration from Lévinas's concepts in various manners: (1) methodology: Lévinas shows what happens to our thought when we follow the principle Sein-lassen in questionning God and when we take this principle as a basis of our theological research; (2) re-thinking: Lévinas offers a critical revision of traditional theological concepts and endows them with existential meaning, (3) marginalized phenomena: Lévinas thoroughly analyzes phenomena, which has been neglected or marginalized by the...
Neighbour in the parables of Luke as motivation for social work with seriously mentally impaired persons

The present thesis connects two areas of studies: social work and theology. It gathers findings gained in social work targeted to people with mental handicap (with special focus on those with heavy forms of mental handicap), findings from socio-psychological studies of human motivation, and from theological analysis of the Gospel of Luke and its parables, and subsequently it endeavours to interconnect these findings. It pursues therein the question of utilising theological knowledge in forming motivation for engagement in social work. The focusing element of this interdisciplinary thesis is the theologically profiled concept of neighbour, which is eventually brought into relation with motivation to perform social work with the mentioned focus group.

Legal standing of neighbours in the procedures under the Building Act The diploma thesis deals with the legal position of neighbours in procedures under the Act No. 183/2006 Coll., on Spatial Planning and Construction Regulation (Construction Act). Although the neighbour is one of the most affected parties in the construction process, the term 'neighbour' itself is not defined in the legal order. The aim of this work is to clarify who is considered to be a neighbour for the purposes of the Construction Act and what legal status does this person have in individual procedures under the Construction Act, including the analysis of possible procedural means to protect his/her rights and legitimate interests. The thesis also points out the legal aspects of the construction process as a comprehensive procedure characterized by a chain of separate and usually successive procedures. In these procedures, the Construction Authority must not only take into account the various public and private interests in the territory, but should also be able to assess the construction project in question not only in terms of construction law but also in terms of civil law. The neighbour's rights

This thesis deals with analysis of neighbours' rights regulations contained in civil code. At first the thesis defines the concept of neighbours' rights, next it is concerned with neighbours' rights as one of the forms of restriction in proprietary rights and the execution of neighbours' rights. The core of the thesis is focused on analysis of legal regulation of particular institutes of neighbours' rights, specifically the questions of immissions, endangering neighbour's immovable by alteration to a land or a construction, fences, access to the land of another and right of way. Finally, the thesis is concerned with protection against infringement of neighbours' rights through self-help, protection provided by administrative authorities and protection provided by judicial authorities. The thesis contains comparison of regulations included in current civil code with regulations included in civil code that will become effective on 1st January 2014 and with regulations implied in The Civil Code of Quebéc.
Legal status of neighbours in the procedures under the Building Act

The main aim of the thesis is to provide explanation of the legal status of the neighbours in the procedures under the Building Act while working with the contemporary literature and the established practice of the courts. The first part of the thesis is devoted to a description of basic concepts. The first chapter explains the concept of structure and plot. The second chapter is describing the concept of neighbour and the evolution of the concept in detail to provide the best means of understanding the possible problems of the concept's interpretations. The final chapter of the first part explores the means of neighbour's defence against interferences of his rights connected with his real estate with special attention to the essentials of objections, as these are the main mean of said defence, while the factual content of the objections is explained in later chapters within the boundaries of individual procedures. The second part is divided into four chapters each dedicated to a certain field of procedures under the Building Act while focusing the neighbour's point of view. The main aim of this rigorous thesis is to describe and analyze current state of law of neighbour law within Act No. 40/1964 Coll., Civil Code and subsequently Act. No. 89/2012 Coll., Civil Code with perceived effectiveness to 1.1.2014. The thesis deals with possible interferences to the law of owners, mostly owners of neighbour's immovable things and protection from these interferences. Then the rigorous thesis contains excursion into regulation of neighbour law in Germany and Great Britain.
